1. Who we are

Bistro City (also known as Nhà Hàng Vui Nhộn) is an online restaurant game. This site, bistrocitygame.com, holds your account; the game itself runs at play.bistrocitygame.com. Both are operated by Hayden, an individual ("we", "us"). There is no company behind the game at present.

These Terms are the agreement between you and us for using the site and the game (together, "the service"). By creating an account or playing, you agree to them. If you do not agree, please do not use the service. How we handle personal data is described in the Privacy Policy.

2. Who can play

  • You must be at least 13 years old to create an account.
  • Where the law of your country sets a higher age for agreeing to the use of your personal data (up to 16 in some countries), you need the consent of a parent or guardian until you reach that age.
  • If you are under the age of majority where you live, you may use the service only with the agreement of a parent or guardian, and you need their permission for every purchase.
  • You may not use the service if we have closed an account of yours for breaking these Terms, or if the law where you live does not allow it.

3. Your account

  • You sign up with an email address, a user name and a password, and confirm the address with a code we email you. Give an address you can actually read: it is the only way to reset your password.
  • One account is for one person. Do not share it, sell it or give it away.
  • Keep your password to yourself. You are responsible for what happens through your account unless it was our fault; tell us straight away at [email protected] if you think someone else has used it.
  • An account can be logged in at one place at a time: logging in on another device or browser ends the earlier session.
  • User names and restaurant names must not pretend to be someone else, staff or an official account, and must not be offensive, hateful, sexual or misleading. We may rename an account or restaurant, or take a name back, where a name breaks this rule.
  • You can ask us to close your account at any time by writing to [email protected] from the account's email address. What happens to your data is explained in the Privacy Policy.

4. Fair play

When you use the service, you agree not to:

  • cheat, or use bots, scripts, modified clients, automation or any other tool that plays for you or changes how the game works;
  • exploit a bug or mistake in the game to gain an advantage, instead of reporting it to us;
  • harass, threaten, insult or spam other players, or use names or messages that are hateful, sexual or unlawful;
  • buy, sell or trade accounts, Sprouts or items for real money or anything of value outside the game;
  • open accounts in bulk, or use several accounts to get around a limit or a suspension;
  • try to get into other players' accounts, or collect their data;
  • attack, overload, probe or otherwise interfere with the service, or access it in any way other than through the site and the game we provide;
  • use the service for anything unlawful.

5. Friends and other players

You can add a friend by typing their exact user name, or by sending them your personal invite link. Either way the other person receives a request, and only they can accept it. Either of you can end the friendship at any time.

Other players can see your user name, your display name if you set one, your restaurant and its name, your level, and messages or gifts you send them in the game. Names and messages come from the players who wrote them, not from us. If something another player wrote or did breaks these Terms, write to [email protected].

6. Virtual currency and virtual items

The game offers a virtual currency ("Sprouts") and virtual items. When you obtain them, by purchase or in play, you receive a limited, personal, revocable, non-transferable licence to use them inside the game. You do not own them. They have no cash value, are not redeemable for money or for anything outside the game, and we may change how they work, their prices and what they buy as the game develops.

Every new account starts with 30 free Sprouts. Free Sprouts, like everything else earned in play, have no purchase price.

7. No transfers or trading for money

You may not sell, buy, transfer or trade Sprouts, items or accounts for real money or anything of value outside the game, and you may not use them through any service we have not authorised. Transfers inside the game are allowed only through features the game provides.

8. Purchases and payment

Sprouts are sold in packs priced in US dollars, on the shop page of this site and from inside the game. Purchases are made through PayNow (paynow.gg), which acts as merchant of record: PayNow charges you, handles tax and issues the receipt, under its own Terms of Use, User Agreement and Privacy Policy. You must be logged in to the account that should receive the purchase, its email address must be confirmed, and you must be authorised to use the payment method. Delivery is automatic and starts as soon as PayNow confirms the payment.

9. Refunds

Refunds follow our Refund & purchases policy, which is part of these Terms. In short:

  • Requests go to [email protected] first, and may then be taken to PayNow.
  • You may ask for a refund of a pack within 14 days of buying it if, when we handle your request, your Sprouts balance still holds at least the number of Sprouts that pack added.
  • When a purchase is refunded or charged back, the Sprouts that purchase added are removed from your balance. If your balance is lower than that, we remove what is there; the balance is never taken below zero.
  • Nothing in these Terms limits rights that consumer law gives you and that cannot be excluded.

10. Suspension and closing of accounts

We may limit, suspend or close an account that breaks these Terms, including for cheating, exploiting bugs, payment fraud, chargeback abuse or trading for real money. Where an account is closed for a serious breach, its Sprouts and items are lost and are not refunded, except where the law requires otherwise. If we think a decision was a mistake we will reverse it; write to [email protected].

When an account is closed, by you or by us, you can no longer log in to it. What we delete and what we keep (for example purchase records) is set out in the Privacy Policy.

11. Availability, changes and the end of the game

The game is run by a very small team. We try to keep it available, but it may be interrupted for maintenance, updates or problems outside our control, and we do not promise that it will always be available or free of errors.

We may change the game: add or remove features, rebalance prices and rewards, correct mistakes and reset things that were obtained through a bug.

We may stop offering the game or parts of it. We will try to give at least 30 days' notice on this site before the game closes. Unused Sprouts are not refunded when the game ends, except where the law requires otherwise.

12. Intellectual property

  • What is ours. The names and logos "Bistro City" and "Nhà Hàng Vui Nhộn", this site, and the software and materials we created are ours or are used by us with the rights we have, and are protected by law.
  • Your licence to play. We grant you a personal, limited, revocable, non-transferable licence to play the game and use the site for your own enjoyment. It does not allow you to copy, resell, reverse engineer or commercially exploit them.
  • Other companies' names. The names of third-party services mentioned on this site, such as PayNow and Cloudflare, belong to their respective holders.
  • What you type. User names, restaurant names and messages you enter stay yours. You allow us to store them and display them in the game.
  • If you think your rights are infringed. If you believe something in the game or on the site infringes your rights, write to [email protected] and we will look into it promptly.

13. Changes to these Terms

We may update these Terms, for example when the game or the law changes. The current version is always on this page, with the date it was last updated. If a change is material, we will announce it at least 14 days before it takes effect, on the site or by email to your account's address. Changes that the law requires or that are needed for security may take effect sooner. If you keep using the service after a change takes effect, you accept the new Terms; if you do not agree, you can stop playing and ask us to close your account.

If something goes wrong, please write to us first at [email protected] — we will try to sort it out. Nothing in these Terms affects the rights the law where you live gives you as a consumer.
